What is personal data?

Data is “personally identifiable” when it can be associated with you and provides information about your behavior or characteristics. Of course, this includes your name, address or postal address; as well as your telephone number or e-mail address, but also e.g. information about your potential interests, provided that this information can be attributed to you personally, directly or indirectly.

 

Data processing of our members and interested parties

Your personal data will be used by the OGBL in accordance with the European Data Protection Regulation (EDPR) and the Luxembourg Data Protection Act for the establishment and management of your membership.

Within the framework of its activities, as provided for by the legislation and its statutes, the OGBL is required to collect and process certain types of personal data as follows:

i.)         Information relating to your identification: surname, first name, telephone number, address, e-mail, identity card/passport number, date and place of birth, signature, social security number;

ii.)        Personal information: age, gender, nationality;

iii.)       Bank information: bank details and bank establishment;

iv.) Occupation/social insurance status: status and current position, name and address of your employer.

The processing of the data of members and those interested in becoming members is carried out for the purposes provided for by law. Further processing, and in particular transfers to third parties, is only possible with your consent under Article 6(1)(a) and in the case of special personal data under Article 9(2)(a) of the GDMPR or because of legitimate interests resulting from legal obligations of the OGBL under Article 6(1)(c) or legitimate interests under Article 6(1)(f) or Article 9(f)(h) of the GDMPR.

Within the framework of its legal and statutory missions, the OGBL may be required to transmit your personal data to the trusted third parties concerned such as:

– the Chamber of Employees;

– the lawyers to whom your file is transmitted following the legal assistance offered by the OGBL;

– the various Social Security bodies;

– the Arbitration Council and the Higher Council of Social Security;

– the training organizations or local or international associations in which you participate following an assumption of responsibility by the OGBL;

– the GMI mutual insurance service.

 

Rights covered

As the persons concerned by the processing of your (specific) personal data, you have the rights set out in the DPMR:

  1. Right to information on the possible processing of the data (Article 15 of the GDMP)
  2. Right of Notification (GDPS s. 14)
  3. Right of rectification (section 16 of the GDPS)
  4. Right to Restrict Treatment (S. 18 of the DPRP)
  5. Right of Withdrawal (Art. 17 of the GDPS)
  6. Right to transferability of data (data portability) (Article 20 of the GDMP)
  7. Right of opposition (Section 21 of the DMPR)
  8. Right of appeal to the supervisory authority (section 77 of the RPDG)
  9. Right of revocation with consent to data processing (Article 7(3) of the GDR)

The processing of your request for information will require a sufficiently clear determination of your identity.

Insofar as we process data on the basis of your consent in accordance with Article 6(1)(a) or Article 9(2)(a) of the GDR, we will inform you, at the time of collection of the data, of your right to revoke your consent at any time, without justification, as well as the possibilities for exercising this right.

Our supervisory authority is the National Data Protection Commission (CNPD). You can address to it your complaint regarding the processing of your data by the OGBL.

 

Duration of storage and deletion

We delete the data of outgoing members after the termination of membership, insofar as we no longer need to archive them to fulfill their own legal obligations under Article 6, paragraph 1 c). of the GDMP, or to grant benefits exceeding the term of membership in accordance with Article 6, paragraph 1 b). of the GDMP, or to preserve legitimate interests.

We will delete the data of those who have contacted us with an interest in joining 3 months after the last contact.

Data that we have collected in accordance with article 6, paragraph 1 a) or article 9, paragraph 2 a) of the GDMPR, will be deleted immediately after notification of revocation of your consent, unless we are legally required or it is in our legitimate interests to continue to archive the data until the expiry of the retention periods.

Retention periods generally end 5 years after the end of the year in which the purpose of the processing has ceased.

 

Processing of data for special purposes for non-members and members

If you are a member of the press, we register your e-mail address to maintain contact. We provide you with information unless you tell us that you no longer wish to do so.

 

Data processing: member services

We provide a range of services to our members. In particular, to identify and advise you as a member who wishes to benefit from the service and to ensure the necessary correspondence with you. This includes in particular your contact details, such as postal address and telephone number, but also the e-mail address for faster contact, in particular to be able to comply with legal deadlines.

In addition, this includes data on the respective legal relationship, which is collected in the corresponding application form.

This data is collected, processed and used to the extent necessary to enforce your rights. If necessary, it is then passed on to external bodies, such as lawyers, etc.

Finally, in many cases of entitlement to services, we also require the member’s bank details in order to make payments. This is also required as soon as the member works on a voluntary basis for the OGBL and receives reimbursement for the amounts paid (e.g. travel expenses).

This data will be stored for 5 years after the conclusion of the business, based on the retention obligations under tax law, and then deleted.

If you send us unsolicited information about your personal data, it will be deleted once your case has been resolved. This is only different if we have a legitimate interest in continuing storage.

Our website uses plugins from the Vimeo video portal. The provider is Vimeo Inc, 555 West 18th Street, New York, 10011 New York, USA.

If you visit one of our sites equipped with a Vimeo plugin, you will be connected to Vimeo’s servers. It tells the Vimeo server which pages you have visited. In addition, Vimeo obtains your IP address. This also applies if you are not connected to Vimeo or if you do not have an account with Vimeo. Facebook

When visiting an OGBL page on Facebook, the Facebook Insights service collects visitor data by tracking it via cookies to allow the operator to statistically evaluate it in order to optimize the functioning of the fan page. This service cannot be deactivated by the operator. The operator receives all data in anonymous form. The basis for this processing is an agreement within the meaning of § 26 GTTB, which Facebook has published at https://www.facebook.com/legal/terms/page_controller_addendum, but over which the operator of a fan page has no influence. It governs, among other things, that

– the rights concerned can be claimed to Facebook Ireland and OGBL,

– Facebook has primary responsibility for the processing of Insights Data under the GTA; Facebook fulfills all obligations under the GTA with respect to the processing of Insights Data,

– Facebook Ireland provides the essence of the insights site supplement to those involved,

– the operators do not make any decisions regarding the processing of the insights data.

Google Maps

This website uses the Google Maps product of Google Inc. By using this website, you consent to the collection, processing and use of data about you by Google Inc, its agents and third parties in an automated manner. You can find the terms of use of Google Maps under “Google Maps Terms of Use”.

Online services on our websites

If you use online services offered on our website, for example to request information material, to make a request via our web forms or to leave a message, we may ask you for your name and other personal information necessary for the service or further processing. Registration Member Area

For security reasons, the use of the members’ area as a closed network of union members requires, in addition to online registration, additional authentication of users as members of the OGBL (your membership number and date of birth are required here).

In order to facilitate the use of consulting services and contact with other members, our membership database also stores your OGBL section and your OGBL union.

Online service: newsletter

We send our newsletter to all registered users registered for this service (“double opt-in procedure”).
